You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.
Section 2 - Our Products
Mutts & Mousers offers pet gift baskets, dog gifts, cat gifts, bakery-made pet treats, toys, accessories, customized pet gifts, pet-and-owner gifts, and related products. Some products may include optional items intended for pet owners, including food, beverages, alcohol where available and permitted, or other owner-oriented additions.
We make reasonable efforts to provide accurate product descriptions, images, prices, availability information, and product details. However, colors, product appearance, packaging, contents, size, presentation, and arrangement may differ from how they appear on your screen due to device settings, photography, availability, preparation requirements, and fulfillment conditions.
Product descriptions, images, prices, availability, delivery eligibility, customization options, and contents are subject to change at any time without notice at our sole discretion.
Products intended for pets are selected with pet-appropriateness in mind. However, products are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and we do not provide veterinary advice. Pet owners are responsible for reviewing product details and determining whether a product is appropriate for a specific pet, including pets with allergies, sensitivities, dietary restrictions, chewing habits, age-related needs, or other special considerations.
Some products may include bakery-made, fresh, perishable, seasonal, specialty, or third-party branded items. Because items are subject to availability, substitutions may be made when necessary. When substitutions are made, we aim to maintain the overall intent, value, pet-appropriateness, and presentation of the selected product.

Some products or tools may allow you to provide customization details, including pet name, pet type, breed, size, age, preferences, occasion, theme, gift message, sender name, recipient name, or other information used to prepare or support a custom gift.
Customization requests are subject to product availability, preparation requirements, delivery timing, and operational feasibility. We reserve the right to modify, decline, or omit customization requests that are unavailable, inappropriate, unclear, unsafe, unlawful, unsuitable for the product, or not feasible to fulfill.
You are responsible for ensuring that gift messages and customization details are accurate and appropriate. We may decline to include gift messages or custom content that is unlawful, abusive, discriminatory, threatening, obscene, misleading, infringing, or otherwise inappropriate.
Section 4 - Orders
When you place an order, you are making an offer to purchase. Mutts & Mousers reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Mutts & Mousers confirms acceptance. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting it, including product selection, customization details, delivery address, recipient information, gift message, delivery date, and contact information. Mutts & Mousers may be unable to accommodate cancellation requests, address changes, product changes, or customization changes after an order is accepted or once preparation, fulfillment, customization, shipping, or delivery coordination has begun.
We may limit, refuse, cancel, or modify orders where we believe an order may be fraudulent, unlawful, inaccurate, incomplete, unavailable, impossible to fulfill, in violation of these Terms, or otherwise inappropriate.
Section 5 - Prices and Billing
Prices, discounts, promotions, delivery fees, shipping fees, and product availability are subject to change without notice. Unless otherwise expressly stated, posted prices do not include applicable taxes, delivery fees, shipping fees, handling charges, customs, import charges, or other applicable charges.
You agree to provide current, complete, and accurate billing and payment information. You authorize us, Shopify, payment processors, and related service providers to charge the payment method provided for the order total, including applicable taxes, fees, shipping, delivery, and other charges displayed at checkout.
If a payment is declined, reversed, disputed, or otherwise not completed, we may cancel, suspend, or delay the order or take other steps permitted by law.
Section 6 - Shipping and Delivery
Mutts & Mousers offers delivery across Canada, with same-day delivery available in the Greater Toronto Area and Greater Vancouver Area for eligible gifts. Delivery options are shown at checkout based on the selected product, delivery address, timing, service availability, and other operational requirements.
Delivery dates, delivery windows, same-day availability, shipping times, and transit times are estimates only and are not guaranteed unless expressly stated otherwise in writing by Mutts & Mousers.
Same-day delivery applies only to eligible products and eligible service areas. Eligibility may depend on the selected gift, customization details, delivery address, preparation requirements, courier availability, and options shown at checkout.
You are responsible for providing accurate and complete delivery information, including recipient name, address, unit or suite number, building name, buzzer code, phone number, delivery instructions, and any relevant access details. We are not responsible for delays, failed deliveries, additional charges, or non-delivery caused by incorrect, incomplete, or inaccessible delivery information.
We are not liable for shipping or delivery delays caused by carriers, couriers, weather, traffic, building access issues, recipient unavailability, incorrect or incomplete delivery information, customs or cross-border processing where applicable, force majeure events, or other circumstances outside our reasonable control.
If a recipient is unavailable, a delivery partner may attempt delivery according to applicable delivery procedures. Depending on the order, location, product type, and delivery method, the order may be left in a safe location, returned, held, delayed, or require additional delivery coordination. Additional fees may apply where permitted.
Section 7 - Perishable, Bakery-Made, and Fresh Products
Some Mutts & Mousers products may include bakery-made, fresh, perishable, seasonal, or time-sensitive items. These products may require prompt handling after delivery and may not be suitable for extended storage, redelivery, or delayed receipt.
Risk of loss, deterioration, or reduced quality may increase if the recipient is unavailable, delivery instructions are incomplete, the delivery location is inaccessible, the order is left unattended, or the product is not handled appropriately after delivery.
Customers and recipients are responsible for reviewing any product information, care instructions, ingredient information, allergen information, and storage guidance provided with the product or displayed on the website where applicable.
Section 8 - Alcohol and Restricted Products
Some products or add-ons may include alcohol or other restricted items where available and permitted by applicable law. Alcohol availability depends on recipient location, product availability, delivery rules, carrier or courier requirements, and applicable laws.
Alcohol, where available, is intended only for pet owners or adult recipients and is never intended for pets. By purchasing any product containing alcohol, you represent that you and the recipient are of legal drinking age and that the order complies with all applicable laws.
Alcohol deliveries may require adult signature, age verification, valid government-issued identification, recipient availability, or additional delivery requirements. We reserve the right to refuse, cancel, or modify any order containing alcohol or restricted products where required or appropriate.
Section 9 - Intellectual Property
The Services, including trademarks, trade names, logos, text, displays, images, graphics, product descriptions, product reviews, video, audio, website design, page layout, icons, features, tools, and the selection and arrangement thereof, are owned by Mutts & Mousers, its affiliates, service providers, or licensors and are protected by applicable intellectual property laws.

muttsmousers.ca is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through our store are made directly with Mutts & Mousers, unless otherwise expressly stated.
Shopify may provide ecommerce platform services, checkout functionality, payment-related services, security, fraud prevention, analytics, and other technology services that support the operation of the website.

To the fullest extent permitted by applicable law, our total liability for any claim arising from or related to the Services or products shall not exceed the amount paid by you for the product or order giving rise to the claim.
